GREATER AUSTIN AREA, TEXAS

Property owners rights issue are being discussed and taken before the community, local and State leaders.

The Better Zoning organization is dedicated to the proposition that cities can optimize land use to satisfy all interested parties: economic development planners; landowners; developers; environmentalists; elected officials; etc. BUT that many cities are not currently achieving the optimum – zoning can be better.

This project is currently active with a five year plan of action to accomplish goals as set by consensus of governements and property owners.

CEDAR PARK, TX

A Cedar Park sign owner had been cited and refused the right to perform sign maintenance on an existing "roof" sign and "pole" sign. The issue was sucessfully resolved in favor of client. The specific issues were:

  • Does the sign ordinance allow simple maintenance (repaint surface areas) or would that be considered a structural change, therefore losing the grandfather status;
  • Is the addition of illumination just cause for a stop work order, and does it constitute a structural change - in this case the sign owner had allowed the electrical to fall into a state of disrepair over a period of time exceeding 5 years.
